Terms & Conditions

The following General Terms and Conditions of Sale and Delivery shall apply to all deliveries made by KEHL Reinigungstechnik GmbH (hereinafter ‘KEHL’) to customers,
unless otherwise specifically agreed between the parties. Any amendments to these terms and conditions require written confirmation from KEHL.

Conclusion of Contract
The contract between KEHL and the customer is only concluded upon the customer placing an order and KEHL accepting it. The customer’s order may be placed by telephone, in writing, by fax or by email. KEHL accepts the order by delivering the goods ordered (including a delivery note) or, at the customer’s request, by sending an order confirmation (by fax, email or post).

Prices
All prices are quoted in CHF excluding value added tax (VAT) and are based on the current price list. VAT is shown separately on the invoice. Prices are kept as stable as possible; however, they may be adjusted upwards or downwards depending on market conditions. Our customer service team will be happy to provide you with information on current prices at any time or to issue you with a quotation containing the latest prices. For certain chemical-technical products, the VOC levy is also charged in accordance with statutory regulations. The VOC (volatile organic compounds) charge is itemised on the invoice. Empty containers are taken back at the customer’s request.

Delivery Dates
If KEHL is unable to meet the agreed dates or deadlines, it shall notify the customer accordingly. The customer undertakes to grant KEHL a reasonable grace period or expressly waives any claim for damages arising from delay.

Delivery Costs/Order Processing
For orders with a net value of CHF 300.00 or more (excluding VAT), delivery is free of charge. For orders with a value of less than CHF 300.00, a small-quantity surcharge of CHF 15.00 will be invoiced. Surcharges for express deliveries shall be borne by the customer.

Title and Risk
Title and risk pass to the customer as soon as the goods have been made available to the customer or to a carrier commissioned by KEHL.

Warranty/Notification Period
The customer is obliged to check immediately upon receipt of the goods whether the delivery corresponds to their order. Any discrepancies must be reported without delay.

Returns
Returns of incorrectly ordered goods will only be accepted if accompanied by the delivery note/invoice. In addition, a handling fee of 20% of the value of the goods will be charged.

Returns must be notified within 10 days of the delivery note date by calling 071 722 70 70; otherwise, the delivery will be deemed to have been accepted. The notified return must then be sent back within 30 days of the delivery note date. Returns will not be accepted after this period has expired. This warranty applies exclusively to new/unused materials. Opened containers and torn packaging will not be accepted for return and will not be refunded. A flat-rate fee of CHF 90.00 will be charged for collection by KEHL. In the case of incorrectly ordered goods, KEHL reserves the right to pass on the actual costs to the client.

Payment
30 days net, no cash discount. Unauthorised cash discounts will be charged retrospectively. Interest on arrears from the due date is 6%. From the second reminder onwards, a reminder fee of CHF 30.00 will be charged. A 5% cash discount is granted for cash purchases at our sales warehouse.

Repair and Maintenance
Repair and maintenance work is carried out by our service engineers on site or at the service workshop.

Model and Design Changes
We reserve the right to make changes to models and designs, and to adjust prices accordingly, at any time.

Chemical-Technical Products (CTP) – Product Safety and Storage Instructions
Hazard warnings and safety advice can be found in the relevant safety data sheet. These can be downloaded, ordered by telephone on 071 722 70 70 or by emailing info@kehl.ch. KEHL products are intended for professional users/specialists. They must be stored in their original, sealed containers. CTPs must be protected from frost, heat and light.

Governing Law and Jurisdiction
Swiss law shall apply exclusively to deliveries made by KEHL. Both parties acknowledge the exclusive jurisdiction of the ordinary courts in St. Gallen for all disputes arising out of or in connection with deliveries made by KEHL.

Warranty Statement
KEHL warrants that the cleaning machines, equipment and products it supplies will function faultlessly for their intended and specified use.

Commencement and Duration of the Warranty
KEHL grants a 12-month warranty on the cleaning machines, equipment and cleaning, care and protection products it supplies. The warranty commences on the invoice date. Second-hand machines are excluded from this warranty. For drive batteries and chargers, the warranties provided by the respective suppliers apply, which range from 6 months to 1 year. Following the completion of repair and/or maintenance work by our service staff, a service warranty of 6 months, from the date of completion, is granted for the work carried out and the spare parts used.

Warranty Claim
The customer must inspect the machinery, equipment and products supplied by KEHL immediately upon delivery and report any defects in writing without delay.

Hidden defects or defects that only become apparent during the warranty period must be reported in writing as soon as they are discovered. A warranty claim may be made in accordance with the warranty terms if, within the warranty period, the proper functioning and the guaranteed use of KEHL products are impaired.

Warranty Limitations / Exclusions
A warranty claim may not be asserted in the following cases:
– for any parts that have been subject to normal wear and tear during use;
– for defects caused by negligent or improper operation;
– if machines and equipment have been opened and/or repaired by third parties without KEHL’s consent;
– if the operating instructions have not been followed;
– if non-original spare parts or accessories have been used.
The right to make a warranty claim may be restricted if non-KEHL cleaning products have been used.

Warranty Terms
KEHL undertakes to rectify all defects reported during the warranty period or to replace defective parts free of charge, provided that the defect can be shown to be due to faulty design, manufacturing defects or unsuitable materials, and provided that there are no grounds for exclusion from the warranty.
